THE MAINTENANCE AND WELFARE OF PARENTS AND

SENIOR CITIZENS ACT, 2007

The Maintenance and Welfare of Parents and Senior Citizens Act, 2007 makes it a legal obligation for children and heirs to provide maintenance to senior citizens. The Act was published in Gazette of India on 31.12.2007. The ACT is to be enforced by the State government concerned. The date on which the Act will come into force will be notified by the State government concerned in the Official Gazette.

State governments may set up maintenance tribunals in every sub-division to decide the level of maintenance. Appellate tribunals may be established at the district level.

Senior citizens who are unable to maintain themselves shall have the right to apply to a maintenance tribunal seeking a monthly allowance from their children or heirs.

If the senior citizen has transferred by way of gift or otherwise, his property, subject to the condition that the relative shall provide the basic amenities and basic physical needs to the senior citizen and such relative refuses or fails to provide such amenities and physical needs the said transfer of property shall be declared void by the Tribunal, if the senior citizen so desires .   1. The blog sounds intresting.I have a question regarding domestic violence to senior citizens by children and whom to approach for help other than police. I understand that there is a person responsible for domestic violence ,situated in collectorate . Could you expand on this

  2. My brother, his wife and her family is torturing my father and step mother. Both of them barely able to meet their livelihood and medicine expenses out of his nominal pension. My father is 64 yrs. and a retired employee but still working as a school bus driver to meet their expenses. They don't want any financial support, but need a peaceful life for the remaining few years. Brother and his wife will not even talk to them living in the same house. He is not ready to live in a separate house and threatens several times to kill them. He & his wife will not allow me, my husband and daughter to visit my parents. Please advice how I can ensure a secure and peaceful life to my parents.
